What is New Zealand Citizen Family Relationship Visa?
New Zealand Citizen Family Relationship visas enables spouse, de facto partner or dependent child of a New Zealand citizen to live in Australia temporarily while the New Zealand citizen is living in Australia on a special category visa subclass 444.
The New Zealand Citizen Family Relationship visa can be lodged onshore or offshore.
Who can get New Zealand Citizen Family Relationship Subclass 461 Visa?
Eligibility requirements:
- You are not a New Zealand citizen and you are not an Australian citizen.
- You are a member of the family unit of a New Zealand citizen who is not an eligible New Zealand citizen.
- Your New Zealand family member must not be an eligible New Zealand citizen for this pathway. Eligible New Zealand citizen refers to the protected Special Category visa arrangements, including qualifying SCV presence on 26 February 2001, qualifying presence for 12 months in the preceding two years, or the applicable protected-status determination. Arrival in Australia before a date alone does not establish the status.
- Your New Zealand citizen family member holds a Special Category visa subclass 444 in Australia, or will travel with you and be granted a subclass 444 visa on arrival.
- Consider adequate health insurance because you are personally liable for healthcare costs while in Australia.
This visa allows the applicant to live, work and study in Australia for 5 years.
How to Stay longer on the New Zealand Citizen Family Relationship Subclass 461 visa ?
You may be able to apply for another subclass 461 visa if you continue to meet the family relationship requirements or if you meet the specific former-family-member rules:
- You continue to be a member of the family unit of a New Zealand citizen who holds a subclass 444 visa or will travel with you and be granted one.
- A former family member applying onshore must hold a 461, or have last held one as their substantive visa, and must not have joined another family unit. An offshore former family member must have held a 461 on their last departure, must not have joined another family unit, and must meet either two years in Australia as a 461 holder in the preceding five years or the substantial-beneficial-ties test with the applicable absence rule.
